Privacy Policy

Effective date: September 30, 2026

WagePath, Inc. ("WagePath," "we," "us") makes payroll and prevailing-wage compliance software for construction companies. This policy explains what information we collect, how we use and share it, and the choices you have. It covers our website (wagepath.com), the WagePath platform (secure.wagepath.com), and the texts and emails we send.

Who this policy covers

  • Our business customers and their users: people at the companies that subscribe to WagePath.
  • Our customers' employees: workers whose payroll and time records their employer manages in WagePath. We handle this information on your employer's behalf, and your employer decides how it is used.
  • Visitors to our website.

Information we collect

  • Account information: name, work email, phone number, role, and sign-in and two-factor authentication details.
  • Payroll and workforce records our customers provide: employee names, contact details, employee IDs, Social Security numbers, job classifications, pay rates, hours and time punches, benefits, deductions, and project assignments. Customers enter this information, import it, or connect a payroll, HR, or timekeeping system.
  • Answers to questions we send for your employer: for example, your confirmation of your time and break information, and when you gave it.
  • Text message records: your mobile number, your consent to receive texts and when it was given, and any opt-out.
  • Billing information: processed by our payment provider. We do not store full card numbers.
  • Usage information: pages visited, browser and device type, IP address, and error reports, collected with cookies and similar tools.

How we use information

  • To run the platform: calculate wages and benefits, produce certified payroll and other compliance reports, and send data to the payroll systems our customers choose.
  • To send texts and emails that you or your employer asked for, such as workforce time and compliance alerts, sign-in codes, and account notices.
  • To suggest settings, such as matching a customer's pay codes to WagePath categories. Some suggestions use AI services.
  • To keep accounts and data secure, including two-factor authentication and audit records.
  • To provide support, bill customers, improve our software, and meet legal obligations.

Text messages (SMS)

  • We text you only if you opted in to WagePath Workforce Time & Compliance Alerts, for example on a consent form from your employer. Consent is voluntary and is not a condition of employment.
  • Message frequency varies and may be up to 8 messages per day. Message and data rates may apply.
  • Reply STOP to opt out at any time, or HELP for help. Our Terms & Conditions are at wagepath.com/terms.
  • We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes.
  • We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. We may provide this information to service providers solely as necessary to operate and deliver the messaging program, subject to contractual restrictions.

How we share information

We do not sell personal information. We share it only in these cases:

  • Service providers that run parts of our service for us, under contracts that limit how they use it: cloud hosting and storage, email and text delivery, payment processing, error monitoring, customer support chat, website analytics, and AI services.
  • Systems our customers connect, such as their payroll, HR, or timekeeping providers, at the customer's direction.
  • Reports our customers file, such as certified payroll reports submitted to government agencies.
  • Legal reasons: when the law requires it, or to protect the rights and safety of people or of WagePath.
  • Business transfers: as part of a merger, acquisition, or sale of assets, with this policy's protections continuing.

How we protect information

  • Social Security numbers are encrypted when stored.
  • Data is encrypted in transit. Accounts support two-factor authentication, and sessions expire automatically.
  • No system is perfectly secure, but we work to protect your information.

How long we keep information

We keep information for as long as we need it to provide the service, and as required by law or by our agreements with customers.

Your choices

  • Texts: reply STOP at any time to stop receiving them.
  • Employees: to see or correct your information, contact your employer. You can also contact us, and we will pass your request to your employer.
  • Users and website visitors: contact us to access, correct, or delete your information, subject to legal limits.
  • Cookies: you can block or delete cookies in your browser settings.

Children

WagePath is built for businesses and their workforce. It is not directed to children under 13, and we do not knowingly collect their information.

Changes to this policy

We may update this policy. We will post the new version on this page with a new effective date.
